1. Introduction & Acceptance

1.1.These Terms of Use (“Terms”) govern your access to and use of Malkiati.qa (the “Platform”), operated by Akaya Information Services WLL (“Malkiati”, “we”, “us”, “our”). By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1.2.These Terms are read together with our Privacy Policy and Cookie Policy, which form part of these Terms. We recommend that you download or print a copy of these Terms for future reference.
1.3.The Platform uses a single, unified frontend login for all users. Feature access varies by user type (Individual or Real Estate Company/Developer). There is no separate agent workspace and no customer API access.

2. Eligibility

2.1.You may use the Platform only if you are at least 18 years old and legally permitted under the laws of the State of Qatar to use online services.
2.2.If you engage in real estate brokerage activities in Qatar, you must hold a valid brokerage license pursuant to Qatar Real Estate Brokerage Law No. 22 of 2017.
2.3.Where required, you must complete verification (e.g., QID for Individuals; CR and, where applicable, brokerage license for REAL ESTATE COMPANY/Developers).

3. Nature of Our Services

3.1.Malkiati is not a real estate broker. We provide a listing, advertising, and leadfacilitation platform. We do not represent buyers or sellers, negotiate transactions, validate property ownership, or collect commissions from Individuals. Content is provided by users and remains their responsibility.
3.2.Leads submitted through the Platform are relayed to the listing party (Individual or REAL ESTATE COMPANY/Developer). We are not responsible for communications or outcomes once a lead has been delivered.
3.3.Property seekers unable to find a suitable property may contact us for assistance. At our discretion, we may route such requests to relevant listing parties. We provide no guarantee regarding availability, response times, or outcomes.

4. Accounts, Verification & Authorizations

4.1.You must provide accurate and lawful information and keep it current.
4.2.We may require document verification (e.g., QID, CR, Brokerage License). Verification badges may be issued or revoked at our discretion, including where documents expire or fail reverification.
4.3.If you are not duly authorized under Qatar law, you must not use the Platform to conduct brokerage or other regulated activities.
4.4.We may limit or disable features where verification is incomplete, invalid, or expired.

5. User Types, Access & Analytics

5.1.Unified frontend access: All users access the Platform through the same interface; features vary by user type.
5.2.Individuals: Singleuser account; may list own properties; cannot add team members; may access analytics and leads for their own listings; may purchase future paid visibility options; cannot charge commission.
5.3.REAL ESTATE COMPANY/Developers: One CRbased business account with role hierarchy and controls detailed in Annexure C (Super Admin, Managers, Brokers), including invitations, branch handling, listing reassignment, analytics, and leads access.
5.4.Analytics & Dashboards: Users who have listed at least one property (Individuals or REAL ESTATE COMPANY/Developers) may access dashboards showing performance (e.g., listing views, profile views, engagement, and visibility insights). Rolebased access applies: Super Admin/Managers may view companywide analytics; Brokers and Individuals may view only their own data. The Platform may also show each user limited activity insights (e.g., properties viewed). We may add, modify, or remove analytics metrics at our discretion.

6. Acceptable Use

You agree you will not:

a)hack, probe, or circumvent security; introduce malware, viruses, worms, or harmful code;
b)scrape, harvest, bulkdownload, or build shadow databases; use bots or automated scripts; circumvent rate limits;
c)submit false, misleading, defamatory, obscene, discriminatory, or otherwise unlawful content; impersonate any person or entity;
d)misuse forms or upload unauthorized promotional content; publish duplicates or bait listings; misrepresent availability or pricing;
e)copy, frame, mirror, or reproduce significant parts of the Platform without written consent;
f)conduct brokerage activities without a valid licence in Qatar;
g)violate image/media standards or watermarking rules in Annexure A.

Breach may result in restriction, removal, suspension, or termination, with postban access prohibited.

7. Content Standards & Intellectual Property (including Watermarking)

7.1.Your Content. You retain ownership of content you upload (text, images, floor plans, videos) and grant Malkiati a worldwide, royaltyfree, revocable, sublicensable license to host, display, distribute, adapt, moderate, watermark (see 7.3), and process such content to operate, secure, and improve the Platform. You warrant you have all necessary rights and consents.
7.2.Our IP. All intellectual property in the Platform (software, UI, text, graphics, compilations, and database rights) is owned by or licensed to Malkiati. You must not extract, reuse, republish, frame, mirror, or commercially exploit any part of the Platform without prior written consent.
7.3.Platform Watermarking of Images. To protect content integrity and reduce copyright misuse, all images uploaded to the Platform (including property photos, floor plans, and renders) may be automatically watermarked with the Malkiati logo. This: (i) discourages unauthorised copying or redistribution; (ii) indicates the original source; (iii) does not transfer or alter ownership rights; and (iv) supports defence against thirdparty copyright claims. Where a REAL ESTATE COMPANY/Developer includes its own watermark, both may coexist provided image quality and property clarity are not compromised. We may position watermarks to balance clarity and protection. Users accept watermarking as a standard protective measure on realestate platforms.
7.4.Listing Quality. Users must follow Annexure A (Content/Listing Quality Policy). We may edit, reorder, watermark, demote, or remove content for legal, security, or quality reasons.

8. Listing Rules (including Brokerage Law compliance)

8.1.Compliance: As per Qatar Real Estate Brokerage Law No. 22 of 2017, only licensed real estate brokers who meet regulatory conditions may legally engage in brokerage activities or charge commissions. Users must not advertise properties for individuals who do not have valid residency permissions in Qatar.
8.2.Individuals: May list only properties they own or are legally authorized to advertise. Malkiati charges no commission to Individuals. Individuals are prohibited from charging commission, referral, or brokerage fees from the customers as per Qatar Real Estate Brokerage Law No. 22 of 2017.
8.3.REAL ESTATE COMPANY/Developers: Must maintain a valid Real Estate Brokerage License (where applicable), obtain owner authorizations, publish one listing per unique property, promptly update status/price/availability, and avoid misrepresentation.
8.4.Listing Freshness & AutoExpiry: Each published property must be refreshed at least once every 10 days to maintain visibility. Listings not refreshed within 10 days may be demoted in ranking or marked expired/inactive. A listing may be refreshed repeatedly as long as it remains “Available.” Once marked “Not Available,” it cannot be refreshed and may be archived.
8.5.Residency Compliance: Users must ensure that property transactions comply with Qatari residency, visa, and sponsorship rules. Listings must not be used to facilitate accommodation for persons without valid legal residency status in Qatar.

9. PhaseBased Features, Fees & Payments

9.1.Phase 1 (Current): One free listing per user (Individuals and REAL ESTATE COMPANY/Developers). No credits/tokens.
9.2.Phase 2 (Future Paid Features): Free listings will continue; optional flatprice paid services may be introduced for all user types, including: featured/promoted listings, subscription packages, paid visibility boosts, banner ads, and lead purchase. We do not operate a credit/points system. Also, promoted placement does not guarantee leads, impressions, or ranking.
9.3.Pricing & Changes: Pricing, features, and terms for paid services may be updated with electronic notice where practicable. We do not guarantee specific lead volumes, impressions, rank, or timetolead.
9.4.Payments & Taxes: Fees (when applicable) are payable in advance and, unless required by law, are nonrefundable except for verified duplicate charges. Taxes/levies (if any) are payable in addition.

10. Data Protection & Privacy

We process personal data in accordance with Qatar Personal Data Privacy Law No. 13 of 2016 and our Privacy Policy. We share lead details with the listing party on a lawful basis for followup relating to a specific inquiry. Additional data protection commitments, roles, retention, breach notification, and security measures are detailed in the Data Processing Addendum (Annexure B).

10.1A. Security & Encryption of Personal Identification Information: To protect user confidentiality and comply with applicable Qatari dataprotection laws, all Personal Identification Information (“PII”) submitted to the Platform — including but not limited to QID numbers, CR details, passport/ID information, phone numbers, email addresses, and WhatsApp numbers — is encrypted and securely stored in our systems. Encryption is applied both in transit (when data is sent to or from the Platform) and at rest (when stored in our databases), using industrystandard security protocols. Access to such information is strictly limited to authorized personnel for verification, compliance, safety, and fraudprevention purposes. Users acknowledge that this security measure forms part of Malkiati’s commitment to protecting sensitive information and reducing risks of unauthorized access or misuse.

10.1B. 0.X Disclosure to Government Authorities: Malkiati may disclose account information, documents, logs, and user activity to Qatari government authorities, regulators, or lawenforcement agencies where required to comply with Qatar law (including fraud prevention, cybercrime investigations, and verificationrelated requests).

11. Cookies

The Platform may use cookies and similar technologies to operate, secure, and enhance your experience. Details are set out in our Cookie Policy.

12. Platform Availability & Changes

We aim for high availability but do not guarantee uninterrupted, errorfree, or virusfree operation. We may suspend, withdraw, discontinue, or change any part of the Platform without notice for maintenance, upgrades, legal, or security reasons. Downloads or materials obtained through the Platform are at your own risk.

12.1A. Data Storage & Backups: While we take reasonable measures to protect and store data, Malkiati does not guarantee that any content, listing, media, lead, message, or account information will always be available or recoverable. Users are responsible for maintaining their own backups of important information.

13. Warranties (Disclaimer)

To the maximum extent permitted by Qatar law, the Platform and all services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the Platform will meet your requirements or be free from harmful components.

14. Limitation of Liability

14.1.We will not be liable for failures due to software/Internet errors or unavailability, or other circumstances beyond our reasonable control.
14.2.We are not liable for any loss of password or account caused by issues attributable to your devices, networks, or software.
14.3.We are not liable for indirect, consequential, special, punitive, or exemplary damages; loss of profit, business, data, reputation, goodwill, or data corruption, even if foreseeable. We are not liable for damage caused by viruses, DDoS, or other harmful material due to your use of the Platform.
14.4.Subject to applicable law, our aggregate liability in any 12month period is limited to the fees paid by you to us for the relevant services during that period (or QAR 10,000 where services are free or bundled), excluding cases of willful misconduct or fraud.

15. Indemnity

You agree to indemnify, defend, and hold harmless Malkiati, its affiliates, officers, employees, and partners from and against claims, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: (i) your content/listings; (ii) your breach of law; (iii) misuse of lead data; (iv) violation of these Terms.

16. Suspension, Termination & PostBan

We may restrict, suspend, or terminate your access if you breach these Terms, upload fraudulent or prohibited content, misuse data, pose security/legal risk, or fail to pay applicable fees. If your account is suspended or terminated, you must not attempt to reregister or access the Platform through any other account or method. We may remove/disable content at our discretion.

17. Feedback & Complaints

We welcome feedback and suggestions for improving our services and aim to acknowledge communications we receive. By submitting feedback, you grant us a right to use it without obligation.

18. ThirdParty Services & Links

The Platform may contain links to thirdparty websites or services. We do not control or endorse these sites and are not responsible for their content, security, or policies. Your use of such sites is at your own risk.

19. Changes to Terms

We may update these Terms at any time. Changes take effect upon being posted on Malkiati.qa. Your continued use signifies acceptance of the updated Terms. Where changes are material, we may provide additional notice where practicable.

20. Governing Law & Jurisdiction

These Terms and any noncontractual disputes or claims arising out of or in connection with them are governed by the laws of the State of Qatar. The Courts of Qatar shall have exclusive jurisdiction.

21. Dispute Resolution

21.1.Internal Resolution and Company Discretion. In the event of any disagreement, concern, or dispute relating to these Terms, your account, listings, lead data, payments, or the Platform, you agree to first submit the matter to Malkiati in writing at support@malkiati.qa. Malkiati will review the matter and may, at its sole and exclusive discretion, determine the appropriate resolution based on Platform rules, safety, compliance, and business interests. Malkiati’s internal findings and decisions shall be considered final and binding, except where Qatar law requires otherwise.
21.2.GoodFaith Process (Nonbinding). We may, but are not obliged to, provide written reasoning, request additional information, or propose corrective measures. This internal review does not constitute a waiver of any contractual rights and is conducted solely to enable a fair assessment.
21.3.Optional Mediation. If a matter cannot be resolved through Malkiati’s internal process, either party may request voluntary mediation within the State of Qatar. Mediation is optional and does not restrict Malkiati’s rights under these Terms.
21.4.No Class or Representative Actions. All disputes must be brought individually. You waive the right to participate in any class, collective, consolidated, or representative action.
21.5.Injunctive or Immediate Relief. Malkiati reserves the unconditional right to seek immediate injunctive, equitable, or emergency relief from the competent courts of Qatar to protect platform integrity, intellectual property, confidential information, business operations, and user safety.
21.6.Final Legal Resolution. If a dispute remains unresolved after the above steps, it shall be governed exclusively by Qatar law and resolved exclusively before the Courts of the State of Qatar, in accordance with Clause 20 (Governing Law & Jurisdiction).

23. Definitions

“Individual”: A natural person using the Platform in their personal capacity.

“REAL ESTATE COMPANY/Developer”: A legal entity (company) using the Platform for commercial real estate activities.

“CR”: Commercial Registration number issued in Qatar.

“Listing”: A property advertisement published on the Platform.

“Lead”: A user’s expression of interest or inquiry regarding a listing.

Annexure A — Content / Listing Quality Policy

A1. General Principles

Accuracy & Honesty: Prices, areas, bedrooms, bathrooms, locations, and availability must be accurate and current. Status must be updated to Under Offer / Rented / Sold / Not Available within 24 hours of change.
Originality & Rights: You must have rights/permissions for all text, images, floor plans, and videos.
Language: Professional tone; no emoji, excessive capitalisation, discriminatory, obscene, or defamatory language.
Contact Info: No phone/email overlays inside images or descriptions.
Geo & Address: Correct zone/area/community; map pin must reflect the property location (privacy masking is allowed but community must be accurate).

A2. Image & Media Standards

Minimum Photos: Residential ≥ 3; Land ≥ 2; Projects/Offplan ≥ 4.
Quality: ≥ 1280×960 px; welllit and in focus; no heavy filters, timestamps, borders, collages, or excessive watermarks that obscure details.
Composition: Show primary rooms, amenities, façade, and floor plan (if available).
Disallowed: Blurry/tilted images, placeholders, promotional banners, QR codes, logos over property photos, explicit content, or people prominently visible (blur if unavoidable).
Watermarking by Malkiati: All uploaded images will be automatically watermarked with the Malkiati logo to deter misuse and indicate source. REAL ESTATE COMPANY/Developer watermarks may coexist where they do not compromise clarity or standards.
Optional: Floor plans with dimensions; secure (HTTPS), adfree 360/virtual tours.

A3. Duplicate & Repetitive Listings

One listing per unique property per company.
Offplan: One listing per unit type/configuration per phase.
Duplicates may be merged/removed; repeated duplication may lead to demotion, rate limits, or suspension.

A4. Pricing & Claims

No bait pricing; show actual current asking price in QAR.
Disclose fees/payment schedules for offplan.
Prohibited claims: “Guaranteed returns,” “100% ROI,” “approved by Malkiati,” “price error for leads only,” or exclusivity without valid proof.
Finance claims must be qualified (e.g., subject to bank approval).

A5. Amenities & Inclusions

Accurately toggle amenities; if furnished, list major items.
Do not imply exclusivity for shared areas unless contractually granted.

A6. Project / Offplan

Include developer name, project name, expected handover, payment plan, unit types, floor ranges, and approvals (where applicable).
Use approved renders marked as illustrative.

A7. Moderation & Enforcement

We may edit, reorder, watermark, or remove content and revoke badges for breaches.
Repeated noncompliance may result in demotion, removal, suspension, or legal reporting.

A8. Verification Badges

Profile Verified (Individual): 100% profile completion, valid QID, active phone/email/WhatsApp. Autorevoked if reverification fails or contact becomes invalid/abusive.
Business Verified (REAL ESTATE COMPANY/Developer): Valid CR, Brokerage License (as applicable), authorized signatory ID, office address, support contact. Badge suspended if CR/license expires or on substantiated complaints.
Listing Verified (optional tier): Documents (title deed/authorization/PoA; exclusivity) validated; periodic spot checks. Reapply after document updates or expiry.

A9. Listing Freshness & AutoExpiry

Refresh every 10 days: Each published property must be refreshed at least once every 10 days to maintain visibility.
No refresh: Listing may be demoted in ranking or marked expired/inactive.
“Not Available”: Once marked Not Available, a listing cannot be refreshed and may be archived.

Annexure B — Data Processing Addendum (DPA)

B1. Roles & Scope

Malkiati acts as Controller for platform account data, analytics, fraud prevention, and lead generation; and as Processor for Customersubmitted content to deliver services.
Customer (REAL ESTATE COMPANY/Developer or Individual listing users) acts as Controller for the listings and personal data it uploads.
For leads: Malkiati is Controller at collection; the listing party becomes Controller upon receipt and must process strictly for inquiry followup.

B2. Lawful Basis & Purpose Limitation

Process data under valid legal bases (e.g., consent, legitimate interests) and do not repurpose leads for unrelated mass marketing without consent and optout.

B3. International Transfers

Any crossborder transfers require appropriate safeguards (contractual clauses, consent, or regulatorapproved mechanisms).

B4. Security Measures (Minimum)

TLS 1.2+, encryption at rest where feasible; leastprivilege access, MFA for admin roles; audit logs; quarterly vulnerability scans; incident response plan.

B5. Data Subject Rights

Honour access, rectification, deletion, portability, and objection requests within statutory timelines; promptly relay requests pertaining to the other party.

B6. Retention & Deletion

Leads: retain 12 months from last interaction, then delete/anonymize unless legally required.
Listings/Media: retain 24 months after expiration/removal for compliance, audits, and fraud detection.
System logs: retain 180 days.

On termination, exports may be requested within 30 days; then we may delete/anonymize subject to legal holds.

B7. Subprocessors

We may use vetted subprocessors (hosting, analytics, communications) under equivalent contractual protections; updated list available on request.

B8. Breach Notification

Notify within 48 hours of becoming aware of a personaldata breach with required details and cooperate on regulator/user notifications.

B9. Audits

On reasonable notice (max once per 12 months), we may provide control summaries or thirdparty assurance. Targeted audits may be arranged where legally required.

Annexure C — Customer Agreement (REAL ESTATE COMPANY/Developer — Frontend Access Model)

C1. Account Ownership & CRBased Access

One account per CR: Each REAL ESTATE COMPANY/Developer may maintain one business account per CR number.
Branches: Branches operating under the same CR form part of the same account. If a branch operates under a separate CR, it is treated as a separate company and must maintain its own account.

C2. Role Hierarchy & Permissions

(a) Super Admin (primary authorized representative): Full control of company profile & CR information, branches, all listings and reassignment, all team members, payments/subscriptions/visibility services, invoices, and companywide analytics. The Super Admin cannot be removed until another authorised Super Admin is appointed and verified.

(b) Managers: May view/manage all listings within the company; reassign listings; add/remove Brokers; send invitations to new team members; view companylevel analytics. Managers cannot update CR/company profile or remove/replace the Super Admin.

(c) Brokers: May create, edit, and manage only their own listings; view analytics and leads for their own listings; manage their own contact availability times. Brokers cannot reassign listings, manage team members, or change company profile/CR.

C3. Team Member Invitations & Departures

Invitations: Once a CRbased account is created, new team members can only be added via invitation sent from the User Management section by a Super Admin or Manager (Brokers cannot invite). Upon acceptance, the user appears under User Management for that CR.
Departures: When any team member (Manager or Broker) is removed or leaves, all their listings transfer to the Super Admin for reassignment. Lead history and inquiry logs remain with the company; departing users may not claim ownership of listings, media, or leads.

C4. Commercial Services (PhaseBased)

Phase 1: One free listing per REAL ESTATE COMPANY/Developer (no fees).
Phase 2: Optional flatpriced services may be offered, including featured/promoted listings, subscription packages, paid visibility boosts, banner ads, and lead purchase. No credit/token system. Availability and pricing may change with notice.

C5. Customer Responsibilities

Publish accurate, lawful, nonmisleading content; promptly update status/price; one listing per unique property; obtain owner permissions; do not upload illegal/defamatory content or malware; do not scrape or reverse engineer the Platform; comply with applicable Qatar laws (including ECommerce Law 16/2010; Cybercrime Law 14/2014; PDPL 13/2016; Brokerage Law 22/2017).

C6. Content Rights & Moderation

Customer owns its content but grants Malkiati a worldwide, royaltyfree, sublicensable license to host, reproduce, display, distribute, adapt, analyze, watermark, and moderate content for services, security, and analytics. We may reorder/demote/remove content for legal/policy reasons.

C7. Fees, Taxes & NonRefundability (when activated)

Fees are payable in advance and nonrefundable (except proven duplicate charges). Taxes/levies apply as per law. Late/failed payments may result in limitation/suspension.

C8. Data Protection

Use lead data only to follow up the related inquiry; ensure security; honour optout requests; notify breaches promptly. See Annexure B.

C9. Suspension/Termination

We may limit, suspend, or terminate services (without refund) for material breach, illegal content, data misuse, scraping, or nonpayment. Fees due become payable immediately.

C10. Liability, Confidentiality & Jurisdiction

Exclude indirect/consequential losses; cap aggregate liability in any 12month period at fees paid for that period (or QAR 10,000 where services are free/bundled). Keep commercial/technical information confidential. Qatar law; exclusive Qatar court jurisdiction.
