We process personal data in accordance with Qatar Personal Data Privacy Law No. 13 of 2016 and our Privacy Policy. We share lead details with the listing party on a lawful basis for followup relating to a specific inquiry. Additional data protection commitments, roles, retention, breach notification, and security measures are detailed in the Data Processing Addendum (Annexure B).
10.1A. Security & Encryption of Personal Identification Information: To protect user confidentiality and comply with applicable Qatari dataprotection laws, all Personal Identification Information (“PII”) submitted to the Platform — including but not limited to QID numbers, CR details, passport/ID information, phone numbers, email addresses, and WhatsApp numbers — is encrypted and securely stored in our systems. Encryption is applied both in transit (when data is sent to or from the Platform) and at rest (when stored in our databases), using industrystandard security protocols. Access to such information is strictly limited to authorized personnel for verification, compliance, safety, and fraudprevention purposes. Users acknowledge that this security measure forms part of Malkiati’s commitment to protecting sensitive information and reducing risks of unauthorized access or misuse.
10.1B. 0.X Disclosure to Government Authorities: Malkiati may disclose account information, documents, logs, and user activity to Qatari government authorities, regulators, or lawenforcement agencies where required to comply with Qatar law (including fraud prevention, cybercrime investigations, and verificationrelated requests).

The Platform may use cookies and similar technologies to operate, secure, and enhance your experience. Details are set out in our Cookie Policy.
12. Platform Availability & Changes
We aim for high availability but do not guarantee uninterrupted, errorfree, or virusfree operation. We may suspend, withdraw, discontinue, or change any part of the Platform without notice for maintenance, upgrades, legal, or security reasons. Downloads or materials obtained through the Platform are at your own risk.
12.1A. Data Storage & Backups: While we take reasonable measures to protect and store data, Malkiati does not guarantee that any content, listing, media, lead, message, or account information will always be available or recoverable. Users are responsible for maintaining their own backups of important information.
13. Warranties (Disclaimer)
To the maximum extent permitted by Qatar law, the Platform and all services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the Platform will meet your requirements or be free from harmful components.
14. Limitation of Liability
15. Indemnity
You agree to indemnify, defend, and hold harmless Malkiati, its affiliates, officers, employees, and partners from and against claims, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: (i) your content/listings; (ii) your breach of law; (iii) misuse of lead data; (iv) violation of these Terms.
16. Suspension, Termination & PostBan
We may restrict, suspend, or terminate your access if you breach these Terms, upload fraudulent or prohibited content, misuse data, pose security/legal risk, or fail to pay applicable fees. If your account is suspended or terminated, you must not attempt to reregister or access the Platform through any other account or method. We may remove/disable content at our discretion.
17. Feedback & Complaints
We welcome feedback and suggestions for improving our services and aim to acknowledge communications we receive. By submitting feedback, you grant us a right to use it without obligation.
18. ThirdParty Services & Links
The Platform may contain links to thirdparty websites or services. We do not control or endorse these sites and are not responsible for their content, security, or policies. Your use of such sites is at your own risk.
19. Changes to Terms
We may update these Terms at any time. Changes take effect upon being posted on Malkiati.qa. Your continued use signifies acceptance of the updated Terms. Where changes are material, we may provide additional notice where practicable.
20. Governing Law & Jurisdiction
These Terms and any noncontractual disputes or claims arising out of or in connection with them are governed by the laws of the State of Qatar. The Courts of Qatar shall have exclusive jurisdiction.

23. Definitions
“Individual”: A natural person using the Platform in their personal capacity.
“REAL ESTATE COMPANY/Developer”: A legal entity (company) using the Platform for commercial real estate activities.
“CR”: Commercial Registration number issued in Qatar.
“Listing”: A property advertisement published on the Platform.
“Lead”: A user’s expression of interest or inquiry regarding a listing.

Annexure B — Data Processing Addendum (DPA)

B2. Lawful Basis & Purpose Limitation
Process data under valid legal bases (e.g., consent, legitimate interests) and do not repurpose leads for unrelated mass marketing without consent and optout.
B3. International Transfers
Any crossborder transfers require appropriate safeguards (contractual clauses, consent, or regulatorapproved mechanisms).
B4. Security Measures (Minimum)
TLS 1.2+, encryption at rest where feasible; leastprivilege access, MFA for admin roles; audit logs; quarterly vulnerability scans; incident response plan.
B5. Data Subject Rights
Honour access, rectification, deletion, portability, and objection requests within statutory timelines; promptly relay requests pertaining to the other party.
B6. Retention & Deletion
On termination, exports may be requested within 30 days; then we may delete/anonymize subject to legal holds.
B7. Subprocessors
We may use vetted subprocessors (hosting, analytics, communications) under equivalent contractual protections; updated list available on request.
B8. Breach Notification
Notify within 48 hours of becoming aware of a personaldata breach with required details and cooperate on regulator/user notifications.
B9. Audits
On reasonable notice (max once per 12 months), we may provide control summaries or thirdparty assurance. Targeted audits may be arranged where legally required.
Annexure C — Customer Agreement (REAL ESTATE COMPANY/Developer — Frontend Access Model)
C1. Account Ownership & CRBased Access
C2. Role Hierarchy & Permissions
(a) Super Admin (primary authorized representative): Full control of company profile & CR information, branches, all listings and reassignment, all team members, payments/subscriptions/visibility services, invoices, and companywide analytics. The Super Admin cannot be removed until another authorised Super Admin is appointed and verified.
(b) Managers: May view/manage all listings within the company; reassign listings; add/remove Brokers; send invitations to new team members; view companylevel analytics. Managers cannot update CR/company profile or remove/replace the Super Admin.
(c) Brokers: May create, edit, and manage only their own listings; view analytics and leads for their own listings; manage their own contact availability times. Brokers cannot reassign listings, manage team members, or change company profile/CR.

Publish accurate, lawful, nonmisleading content; promptly update status/price; one listing per unique property; obtain owner permissions; do not upload illegal/defamatory content or malware; do not scrape or reverse engineer the Platform; comply with applicable Qatar laws (including ECommerce Law 16/2010; Cybercrime Law 14/2014; PDPL 13/2016; Brokerage Law 22/2017).
C6. Content Rights & Moderation
Customer owns its content but grants Malkiati a worldwide, royaltyfree, sublicensable license to host, reproduce, display, distribute, adapt, analyze, watermark, and moderate content for services, security, and analytics. We may reorder/demote/remove content for legal/policy reasons.
C7. Fees, Taxes & NonRefundability (when activated)
Fees are payable in advance and nonrefundable (except proven duplicate charges). Taxes/levies apply as per law. Late/failed payments may result in limitation/suspension.
C8. Data Protection
Use lead data only to follow up the related inquiry; ensure security; honour optout requests; notify breaches promptly. See Annexure B.
C9. Suspension/Termination
We may limit, suspend, or terminate services (without refund) for material breach, illegal content, data misuse, scraping, or nonpayment. Fees due become payable immediately.
C10. Liability, Confidentiality & Jurisdiction
Exclude indirect/consequential losses; cap aggregate liability in any 12month period at fees paid for that period (or QAR 10,000 where services are free/bundled). Keep commercial/technical information confidential. Qatar law; exclusive Qatar court jurisdiction.
